Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Synaptic (“the Service”), a Visual Studio Code extension developed and operated by GoLab (“we”, “us”, “our”). By using the Service, you agree to be bound by these Terms.

1. Service Description

Synaptic is a Visual Studio Code extension that integrates artificial intelligence assistants to help developers with software engineering tasks. The Service connects to third-party AI providers to process prompts and return AI-generated responses within the VS Code editor.

2. Account Registration

To use Synaptic, you must sign in using a supported authentication provider (Google or GitHub). By signing in, you authorize us to access your basic profile information (name, email address, and profile photo) for account creation and identification purposes.

You are responsible for maintaining the security of your account and for all activities that occur under your account.

3. Subscription Plans and Pricing

Synaptic offers the following subscription plans:

• A “cycle” represents one complete AI-assisted interaction (prompt and response).
• All plans include access to the same features; only the number of monthly cycles differs.
• Cycle quotas reset on the first day of each calendar month.
• Unused cycles do not carry over to the next month.
• Prices are in US Dollars (USD) and may be subject to applicable taxes depending on your jurisdiction.

We reserve the right to modify pricing with 30 days’ prior notice to active subscribers.

4. Payment and Billing

All payments are processed by Lemon Squeezy (Lemon Squeezy LLC), which acts as our Merchant of Record. By subscribing to a paid plan, you also agree to Lemon Squeezy’s Terms of Service.

• Paid subscriptions are billed monthly on a recurring basis.
• Billing begins at the time of subscription.
• You may cancel your subscription at any time through the Lemon Squeezy Customer Portal. Cancellation takes effect at the end of the current billing period.
• Lemon Squeezy handles all payment processing, invoicing, tax calculation, and compliance.

5. Fulfillment

Synaptic is a digital product delivered instantly:

1. Install the Synaptic extension from the Visual Studio Code Marketplace (free).
2. Sign in with your Google or GitHub account.
3. Subscribe to a paid plan through the in-app subscription flow.
4. Your cycle quota is activated immediately upon successful payment — no manual intervention required.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Attempt to circumvent usage quotas, rate limits, or security measures.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated scripts or bots to interact with the Service outside of normal VS Code usage.
• Share, resell, or redistribute your account access to third parties.
• Use the Service to generate content that is harmful, abusive, or violates the terms of the underlying AI providers.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

• Our IP: The Synaptic extension, its code, design, branding, and documentation are the property of GoLab. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the Service.
• Your Content: You retain ownership of all code, prompts, and content you create or process through the Service. We do not claim any rights over your content.
• AI-Generated Output: Responses generated by AI providers through the Service are subject to the respective AI provider’s terms regarding output ownership.

8. Third-Party AI Providers

The Service integrates with third-party AI providers (including but not limited to Anthropic, OpenAI, and Google). Your use of AI features is also subject to the terms and policies of these providers. We are not responsible for the availability, accuracy, or content of AI-generated responses.

When using “Bring Your Own Key” (BYOK) mode, you are responsible for compliance with the terms of service of the AI provider whose API key you use.

9. Privacy and Data

• We collect and store basic profile information (name, email, profile photo) from your authentication provider.
• We store usage metadata (cycle counts, session logs) in Firebase for quota management and service improvement.
• We do not store the content of your prompts or AI responses on our servers. Prompt content is sent directly to the selected AI provider and is subject to their privacy policies.

10. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
• The Service depends on third-party infrastructure (VS Code Marketplace, AI providers, Firebase, Lemon Squeezy) which may experience outages beyond our control.
• We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

AI-generated content may contain errors, inaccuracies, or inappropriate suggestions. You are solely responsible for reviewing and validating any code or content generated through the Service before using it in production.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Termination

• You may stop using the Service and cancel your subscription at any time.
• We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
• Upon termination, your right to use paid features ceases at the end of your current billing period. Your data may be deleted in accordance with our data retention practices.

14. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers of material changes via email at least 15 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Chile. Any disputes arising from these Terms shall be resolved in the courts of Concepción, Chile.
